EEE and Batteries Register Obligation

The obligation to join a Collective Funding System and to register with the EEE and/or Batteries Registry concerns:

    • Manufacturers

    • Manufacturers-Importers

    • Distributors

Manufacturers

Who is the Producer of EEE?

According to the provisions of Legislative Decree 49/2014, Producer of EEE is defined as:

"the natural or legal person who, whatever sales technique is used, including distance communication, within the meaning of Section II, of Chapter I, of Title III of Legislative Decree No. 206 of September 6, 2005 concerning consumer protection in respect of distance contracts:

    • is established in the national territory and manufactures EEE bearing its name or trademark, or commissions the design or manufacture of EEE and markets it in the national market bearing its name or trademark;

    • is established in the national territory and resells in the national market, under its own name or trademark, equipment manufactured by other suppliers; the reseller is not considered to be a 'manufacturer' if the equipment bears the manufacturer's trademark in accordance with No. 1;

    • is established in the national territory and places EEE from a third country or another EU member state on the national market in the course of a professional activity;

    • Is established in another Member State of the European Union or in a third country and sells EEE on the domestic market by means of distance communication techniques directly to households or users other than households"

The Producer may coincide with the Distributor and Importer, and is therefore required to register with the EEE Registry.

Who is the Manufacturer of Batteries and Accumulators?

According to the provisions of Legislative Decree 188/2008, Producer of Batteries and Accumulators means:

"any person who places batteries or accumulators, including those incorporated into appliances or vehicles, on the national market for the first time on a professional basis, regardless of the sales technique used, including distance communication techniques defined in Articles 50, et seq. of Legislative Decree No. 206 of September 6, 2005, implementing Directive 97/7/EC on the protection of consumers in respect of distance contracts"

Manufacturers-Importers

These are the people who place in the domestic (Italian) market:

    • Batteries and Accumulators

    • Electrical and Electronic Equipment from import.

A person who imports from:

    • Countries within the European Community (e.g., Germany)

    • Non-EU countries (e.g. China, Switzerland)

Distributors

In addition to producers, it is important to note that Distributors also have obligations, albeit different from those of EEE and/or Battery Manufacturers.

Who is the Distributor of Electrical and Electronic Equipment?

Here we can make a double distinction:

    • EEE distributor: a natural or legal person registered in the Business Register who, operating in the supply chain, makes an EEE available on the market;

    • EEE retail distributor: an individual or legal entity that makes an EEE available to the end user.

Who is the Distributor of Batteries and Accumulators?

    • Battery and Accumulator Distributor: any person who, as part of a business activity, supplies batteries and accumulators to an end user.
